O R D E R

The prayer sought for herein is for a Writ of Mandamus directing the first respondent herein to dispose within time frame the petitioner appeal dated 29.05.2020 made as against the order of second respondent dated 16.03.2020 in Na.Ka.1511/2018/C.

2. In order to get patta for the land in S.No.870/11 and 870/14A, the petitioner had given a request which was rejected by the Revenue Divisional Officer ie., the 2nd respondent vide his proceedings dated 16.03.2020. As against the said order, the petitioner preferred a revision before the 1st respondent District Revenue Officer on 29.05.2020. However, the said revision has so far not been decided by the 1st respondent. Therefore, in order to consider the same and to decide the said revision at the earliest on merits, the petitioner has moved the present writ petition with the aforesaid prayer.

Heard the learned counsel for the petitioner, who submitted that as against the order passed by the 2nd respondent dated 16.03.2020 though appeal was filed on 29.05.2020 so far the same has not been disposed of and therefore a direction can be given to the 1st respondent to decide the said appeal at an early date.

Heard the learned Additional Government Pleader for the respondents who would submit that, if the appeal is pending before the 1st respondent from May 2020, certainly that would be considered, of course, after giving an opportunity of being heard to the petitioner as well as the private respondents within a time frame that may be stipulated by this Court.

Considering the limited scope of the prayer sought for and having regard to the submissions made by the learned Additional Government Pleader, this Court is inclined to dispose of this writ petition with the following order. "That there shall be a direction to the 1st respondent to decide the appeal dated 19.05.2020 filed by the petitioner against the order passed by the 2nd respondent dated 16.03.2020 after giving an opportunity of being heard to the petitioner as well as the private respondents and pass orders thereon within a period of eight weeks from the date of receipt of a copy of this order."
