The petitioner herein alleging harassment by the respondent police, came before this Court seeking protection.

From the averments made in the petition, this Court finds that there is a dispute between the petitioner and the defacto complainant regarding sharing of water in a common well. Based on the complaint, the petitioner was summoned to appear for the enquiry before the Investigating Officer. The petitioner on 06.10.2023 appeared and gave his statement. However, the complainant has not appeared before the Investigating Officer for completion of the enquiry.

In the above circumstances, it is sufficient to direct the respondent police in case the presence of the petitioner is required, it can be done on issuance of summons only. If the petitioner receives any summons shall appear before the police and cooperate with the investigation. 2/4

With the above directions, this Criminal Original Petition is disposed of.
