R.Venkata Subramania v. South Arcot Saravanabava

CMP.Nos.13420, 13421, 13422, 13423, 13424 & 13425 of 2017 in S.A.No.456, 457 of 2001 RMT.TEEKAA RAMAN,J., CMP.Nos.13420, 13423 of 2017, have been filed to condone the delay of 5140 days in filing the petitions to set aside the abatement caused due to the death of the sole appellant viz., R.Venkatasubramania Chettiar in the above Second Appeals. CMP.Nos.13421, 13424 of 2017 have been filed to set aside the abatement caused due to the death of the sole appellant/R.Venkatasubramaia Chettiar in the above Second Appeals. CMP.Nos.13422 & 13425 of 2017 have been filed to bring on record the proposed appellants herein viz.,V.Shyamsundar, V.Udayasankar, V.Swaroop Sundar & M.Jayashree as legal reprsentatives of the deceased/sole appellant.

The factum of the death of the sole appellant viz., R.Venkatasubramania Chettiar in the appeals in S.A.Nos.456 & 457 of 2001 as their legal representatives are not in dispute. Considering the submissions made by the learned counsel for the applicants and being satisfied with the reasons stated in the affidavit filed in support of these petitions, in the interest of justice, all these petitions are allowed.

The Registry is directed to carry out the necessary amendments within a period of two weeks.

Post the matter after three weeks.
