This application has been filed by the applicants to condone the delay of 99 days in filing the written statement in the above suit.

2. According to the applicants who are the defendants in the main suit, the written statement had not been filed due to the personal issues of the first defendant which forced him to travel outstations on regular basis and thereby, he was unable to contact the counsel. Hence, there is a delay of 99 days in filing the written statement.

3. The other side has no serious objection in allowing this application.

4. Considering the reasons stated in the affidavit and in order to give fair chance to the applicants / defendants to put forth their defense, this application has to be allowed.

5. Accordingly, this application is allowed and the written statement of the defendants is taken on file.
