Challenging the order passed in Crl.A.No.25 of 2023 on the file of Addl. District and Sessions Judge, Dharmapuri, the petitioner preferred the above Criminal Revision Case, however there is a delay of 249 days in representing the above Criminal Revision Case arose. Hence, the present petition has been filed to condone the delay in representing the Crl. R.C..

2. Mr.V.G.Guhan Murugan, learned counsel for petitioner submitted that the above Criminal Revision Case was returned for rectifying certain defects on 18.12.2024 and again on 24.01.2025, however, due to Pongal holidays and other personal inconvenience, it was represented on 04.02.2025. Though it was again returned, it was not informed by junior to counsel on record, who had earlier handled the matter left the office. Thereafter, he came to know about the same, hence, there is a delay of 249 days arose in representing the above Criminal Revision Case and the said delay caused is neither willful nor wanton, but for the above said reasons. Accordingly, he has filed the above petition.

3. Dr.C.E.Pratap, learned Government Advocate (Crl. Side) for respondent appeared and raised formal objections in allowing this petition.

4. Considering the facts and circumstances and on considering the reasons stated by the petitioner in the affidavit that the bundle was misplaced, to give one more opportunity to the petitioner, this court is inclined to allow this petition. Registry is directed to number the above Criminal Revision Case if it is otherwise found to be in order. 25.09.2025 rpp
