2. Despite service of notice and name of the respondent having been printed in the cause list, the respondent has not chosen to appear either in person or through counsel.

3. Considering the explanation given in the affidavit filed in support of the petition that the delay was due to the ill health of the petitioner/appellant, the delay of 28 days in filing the appeal is condoned and this petition is allowed.
