This Criminal Original Petition has been filed, seeking a direction to the respondent police to register the FIR based on the complaint given by the petitioner dated 04.11.2022.
2. Heard the learned counsel for the petitioner and the learned Government Advocate (Crl. Side) for the respondents.
3. The learned counsel for the petitioner submitted that the petitioner belongs to SC/ST community and some identified persons came on 24.10.2022 at about 5.30 p.m. and abused the petitioner by caste calling and assaulted him with weapons; though a complaint has been given in this regard to the respondent police on 25.10.2022, so far no action has been taken.
4. The learned Government Advocate (Crl. Side) submitted that on the complaint given by the petitioner, a current paper enquiry has been initiated in C.S.R No.1522 of 2022 and the enquiry is pending. 2/4
5. Since the complaint has been given as early as on 22.10.2022, the 3rd respondent is directed to complete the enquiry within a period of four weeks from the date of receipt of a copy of this order. It is needless to state that while enquiring the complaints, the guidelines laid down by the Hon'ble Supreme Court in the case of Lalita Kumari vs. Government of Uttar Pradesh and others [2014 (2) SCC (1)] should be followed.
6. With the above direction, this Criminal Original Petition is disposed of.
