This petition is filed to condone the delay of 42 days in filing the restoration petition pending in Crl.M.P.SR.58161 of 2023 to restore the Crl.A.No.636/2022 which was dismissed for default on 14.09.2022.

2. Though notice served on the respondent and his name being printed in the cause list, there is no representation for the respondent.

3. Heard the learned counsel appearing for the petitioner.

4. Having regard to the submissions made by the learned counsel for the petitioner and on being satisfied with the reasons stated in the accompanying affidavit filed in support of this petition, the delay of 42 days in filing restoration petition to restore the Crl.A.No.636/2022 is condoned and the petition is ordered.
