ORDER
This Suo Motu Case is dealt with in an extraordinary manner by the Dedicated Bench, pursuant to Suo Motu W.P.(Crl.) No.618 of 2025. 2.The case, Cr.No.162 of 2019 was registered for an alleged offences under Section 294 (b) and 506 (i) of IPC and Section 4 (1) (j) of the Tamil Nadu Prohibition Act. The incident occurred on 23.05.2019. The allegation is that the accused came in an inebriated manner and abused the defacto complainant. There is no previous case or subsequent case as against the accused. The case is pending from the year 2021 and it is posted at the stage of summons. It is reported that the defacto complainant passed away. Considering the factual matrix and context, any further continuance of the proceedings will impinge upon the right of the accused for speedy trial. Accordingly, the proceedings in CC.No.97/2021 on the file of the JUDICIAL MAGISTRATE COURT NO.I, Kancheepuram Taluk, Kancheepuram, is quashed and this Suo Motu Transfer Case is disposed of. 08.09.2025 Jer electronically alone. The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary.
