This petition has been filed to condone the delay of 39 days in filing the appeal against the judgement and decree dated 21.12.2023 made in MACTOP.No.5186 of 2019 on the file of the Motor Accident Claims Tribunal, Chief Judge, Court of Small Causes, Chennai.

2. Heard the learned counsel for the appellant and the learned counsel for the second respondent.

3. Though the name of the first respondent is printed in the cause list, no one appeared on behalf of the first respondent.

4. Being satisfied with the reasons stated in the affidavit filed in support of this petition, this Court is inclined to order this petition.

5. Accordingly this Petition is ordered.

Registry is directed to number the appeal, if it is otherwise in order and post the main appeal for admissions.
