The prayer sought for herein is for a Writ of Mandamus directing the respondents to consider the representation of the petitioner dated 11.08.2022 pending on the file of the respondents within the time frame as may be stipulated by this Court.
2. It is the claim of the petitioner that she has built up a house in the house site at S.No.66/4, T.S.No.49/1, Block No.48, Ward-001 at Kadumbadi Ammal Koil Street, Kodungaiyur, Chennai 600 118 and has been residing there for long years. When that being so, the petitioner wanted to settle the proprty in favour of her daughter and when a document to that effect was filed before the registering authority, the genuineness of the patta issued in favour of the petitioner was verified by the registering authority with the Tahsildar concerned, who in turn, vide letter dated 28.04.2022 seems to have stated even though patta has been given, as per the patta the subdivision has not been made and the same has not been recorded in the register concerned.
3. In view of the aforesaid position, the document submitted by the petitioner seems to have been not registered. Only at that juncture, the petitioner has given a representation to the respondents on 11.08.2022 and in order to consider the same and pass appropriate orders, the petitioner has 2 / 4
approached this Court by filing the present writ petition.
4. Heard Mr.P.Arasan, learned counsel for the petitioner and Ms.N.Senthil Selvi learned Government Advocate appearing for the respondents.
5. Learned Government Advocate would submit that the representation of the petitioner dated 11.08.2022 would be considered and decided on merits and in accordance with law by the 3rd respondent within a time frame that may be stipulated by this Court.
6. In view of the aforesaid submission made by the learned Government Advocate and having regard to the factual matrix of the case, this Court is inclined to dispose of this writ petition with the following order: That there shall be a direction to the 3rd respondent to consider the representation of the petitioner dated 11.08.2022 and pass necessary orders thereon on merits and in accordance with law within a period of six weeks from the date of receipt of a copy of this order.
