ORDER

This Suo Motu Case is dealt with in an extraordinary manner by the Dedicated Bench, pursuant to Suo Motu W.P.(Crl.) No.618 of 2025.

2. The allegation in this case is that on 15.06.2018 when the persons belong to scheduled tribe caste got married and when they were produced before the concerned Judicial Magistrate, the relatives of the married couple indulged in road roco. Therefore, a case in Cr.No.799 of 2018 was registered for an offence under Section 143, 283 and 506 (i) of IPC. The case is pending at the stage of summons. Considering the factual matrix, context of the case, the antecedents of the accused persons, the reason for absence from their usual place, and the submission that, despite best efforts, the summons could not be served, it is evident that even if the accused are brought to face trial, it would impinge upon their right to speedy trial. Due to the passage of time, no meaningful trial is likely to be taken place and no useful purpose would be served.

Accordingly, the STC.No.697/2021 on the file of the JUDICIAL MAGISTRATE NO.I, Tiruvannamalai Taluk, Tiruvannamalai, stands quashed and the Suo Motu Transfer Case stands disposed of. 08.09.2025 Jer electronically alone. The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary.
