Respondents Prayer: Writ Petition under Article 226 of the Constitution of India praying for the issuance of a writ of Mandamus directing the 2nd respondent to provide the petitioner a copy of the answer sheet of Law Paper I, with marks awarded during valuation for each answer and re-total the marks awarded for Law Paper I of the written examinations conducted by the 2nd respondent in the examination held on 05.08.2023 vide Notification No.34/2023 dated 01.03.2023 as far as the Petitioner's Registration No.3420235301 is concerned and consequently rectify the mistake either in totalling or in evaluating the answer if any found to have been omitted.

J U D G M E N T

Ms.K.Subhashini learned counsel for the writ petitioner would submit that the petitioner, though sought for a combined prayer of getting the photocopy of the answer script with marks awarded during valuation as well as re-totalling of marks in Law Paper-I in the written examinations conducted by the 2nd respondent on 05.08.2023 vide Notification No.34 of 2023 dated 01.03.2023, insofar as re-totalling is concerned, the petitioner has given up the said prayer. The said submission made by the learned counsel for the petitioner is taken on record.

2. As directed earlier, today on behalf of the second respondent a report has been filed, wherein inter-alia the second respondent has stated the following:

13. Information under Right to Information Act and Claim for Revaluation / Re-totalling:

(a) No candidate is permitted to peruse / obtain copies of the answer sheets (Preliminary and Main Examination) till finalization of the recruitment process.

(b) ..........

(d) Request for re-valuation and re-totalling of marks in the answer sheets of the preliminary examination and main examination will not be entertained.

(e) ......

In this connection, it is respectfully submitted that the copy of the answer sheets of the petitioner bearing the Registration No.3420235301, Law Paper-I is now ready to furnish to the candidates."

3. Relying upon this submission made in the report, learned counsel for the second respondent would also submit that a photocopy of the answer script of Law Paper-I is ready. Accordingly he has produced the same for the purpose of providing the same to the petitioner and submits that if the Court wants to give the answer script to the learned counsel for the petitioner, it can be given to her, he stated.

In view of the same, the photocopy of the answer script of the petitioner in Law Paper-I of the written examinations conducted by the 2nd respondent in the examination held on 05.08.2023 vide Notification No.34 of 2023 is handed over to Ms.K.Subashini (Enrolment No.MS/964/1996), learned counsel appearing for the petitioner, who on receipt of the same, confined to the

first part of the prayer by giving up the second part of the prayer with regard to the re-totalling of the marks.

5. Recording the aforesaid development, this writ petition is disposed of. No costs.
