This petition has been filed seeking to condone the delay of 158 days in filing the petition to restore the C.R.P. No.3977 of 2016, which was dismissed for default on 12.01.2017.

2. Mr.B.Tamilnidhi, learned Addl. Government Pleader appearing for revision petitioners submitted that after receiving notice in the execution application, they came to know about the earlier proceedings. However, there is a delay of 158 days in filing this petition arose. The delay is neither willful nor wanton, due to the inadvertence of earlier officials. Hence, he filed this petition to condone the delay in filing the petition to restore the above C.R.P.

3. Mr. S.Ramachandran, learned counsel for respondent appeared and submitted that he has no objection in allowing this petition.

4. Considering the facts and circumstances, and being satisfied with the reasons assigned in the affidavit filed in support of the petition is justifiable one and if a chance is not given to them, their valuable right will be defeated, this Court is inclined to allow this petition to condone the delay of 158 days and to restore the above Civil Revision Petition.

5. Post the matter on 07.11.2022.
