Crl. M.P. No.14506 of 2024 in Crl. O.P. No.13269 of 2024 P. DHANABAL,J., This petition has been filed seeking to modify the condition imposed by this Court in Crl. O.P. No.13269 of 2024 vide order dated 25.09.2024 by permitting the petitioner to deposit a sum of Rs.50 lakhs in the Cr. No.136 of 2024 before the concerned Court instead of handing it over to the defacto complainant and further permit the petitioner to execute sureties before the learned Judicial Magistrate, Sathyamangalam, Erode instead of the Additional Mahila Court, Coimbatore.

The learned counsel appearing for the petitioner would contend that the defacto complainant is not ready to receive the amount of Rs.50 lakhs as agreed by the petitioner, as one time settlement and therefore, he prays to modify the condition to deposit the above said amount before the Court concerned to the credit of Cr. No.136 of 202.
3. The respondent police have not raised any objection, since already this Court has passed orders.
4. Considering the representation made by both sides' counsels,
considering the fact that already the petitioner is ready to pay a sum of Rs.50 lakhs to the defacto complainant and this Court also passed an order to pay a sum of Rs.50 lakhs to the defacto complainant and now the defacto complainant is not ready to receive the amount, it is appropriate to modify the order that the petitioner has to deposit an amount of Rs.50 lakhs before the trial Court to the credit of Cr. No.136 of 2024.
5. Therefore, the condition that the petitioner shall pay a sum of Rs.50 lakhs to the defacto complainant, is hereby modified to the effect that the petitioner shall deposit a sum of Rs.50 lakhs before the trial Court to the credit of Cr. No.136 of 2024 and the other conditions remain intact.
6. Accordingly, the Criminal Original Petition is ordered. 21.10.2024 mjs
