2. Heard the learned Senior counsel appearing on behalf of the petitioners, the learned Senior Counsel appearing for the defacto complainant and the learned Government Advocate (Crl.Side) appearing for the respondent police and perused the materials available on record.
3. Learned Senior counsel for the petitioners submitted that summon dated 28.09.2024 was issued to the petitioners based on the complaint preferred by the defacto complainant. Though the petitioners appeared before the respondent police and submitted all the required materials, another summon dated 03.10.2024 was issued for a different
complaint arising out of similar set of facts. He further submitted that as per directions of this Court dated 25.10.2024, the petitioners appeared before the respondent police on 30.10.2024 and furnished all the relevant materials with regard to the dispute. Since the respondent has not concluded the preliminary enquiry so far, the petitioners are constrained to file the above criminal original petitions. He also submitted that the petitioners are ready to co-operate with the respondent police for enquiry.
4. The learned Government Advocate (Crl.Side) appearing for the respondent police admitted that the petitioners have furnished all the relevant materials before the respondent police. Further he submitted that the respondent will conduct the enquiry and conclude the proceedings shortly.
5. In view of the above, the respondent police is directed to complete the proceedings regarding the preliminary enquiry within a period of 10 days from today. It is made clear that the respondent police is directed not to harass the petitioners under the guise of enquiry.
6. With the abovesaid direction, the Criminal Original Petitions are
disposed of.
