The application to condone the delay of 1617 days in representation of the written statement, which was filed defectively with delay condonation application.

2. From the affidavit, this Court finds that the written statement was filed along with the condone delay application to condone the delay of 58 days in filing the written statement. The written statement and condone delay application were presented in the Registry on 09.01.2015 after serving copy to the plaintiff's counsel. However, for the reason stated in the affidavit the defendants could not take back the papers returned for curing the defects and represent the same in time. The enormous delay of 1617 days has crept in representing the written statement. Though the delay of 1617 days is enormous since the defendants 1/3

have taken all endeavour to file the written statement, the delay of 1617 days in representing the written statement is condoned on condition that the applicants/defendants shall pay cost of Rs.10,000/- to the High Court Legal Services Authority, Chennai on or before 05.03.2020. On such payment, the delay in representation of the written statement will be condoned and the Registry shall number the condone delay application and list the matter before this Court.
