Respondents Prayer: Petition filed under Article 226 of the Constitution of India seeking a writ of mandamus, directing the respondents to dispose the petitioner representation dated 09.05.2022 and 14.09.2023 to remove the encroachment in S.No.191/8-1.54 cents Punchai DC lands in No.33 Morasapalli Village, Pernambut Taluk, Vellore District. ORDER

(Made by the Hon'ble Chief Justice) Heard Mr.C.Venkatesan, learned counsel for the petitioner and Mr.P.Muthukumar, learned State Government Pleader for respondents 1 to 5.

2. Learned counsel for the petitioner submits that the sixth respondent has occupied the property owned by the petitioner. The property is meant for depressed class and the petitioner is from the depressed class. It is submitted that the sixth respondent does not belong to the depressed class.

3. It appears that the petitioner has executed the documents in favour of the sixth respondent and has taken money from the sixth respondent.

4. If the case of the petitioner is that the documents have been executed by coercive or fraudulent methods, then the remedy for the petitioner would be elsewhere. The petitioner is at liberty to take appropriate proceedings as may be permissible under law.

5. In the light of that, the writ petition stands dismissed. There will be no order as to costs.
