Prayer : Criminal Original Petition is filed under Section 482 of the Criminal Procedure Code, praying to call for the records pertaining to M.C.No.54 of 2021 pending on the file of the learned Additional Family Court, Coimbatore and quash the same as abuse process of law and by allowing the present quash petition.

ORDER

This Criminal Original Petition has been filed to to call for the records pertaining to M.C.No.54 of 2021 pending on the file of the 1/4

learned Additional Family Court, Coimbatore and quash the same.

2. Heard the learned counsel for the petitioner and the learned counsel for the respondent.

3.Today, when the matter is taken up for hearing, the petitioner and the defacto complainant have appeared before this Court through video conferencing Further, the petitioner has filed an affidavit of undertaking stating that the matter was amicably settled between the parties as per the Joint Memo of Compromise to that effect.

4. The respondent has appeared before this Court, she admits that the matter was amicably settled between the parties and she is not inclined to proceed with the matter and accepted the terms of compromise.

5. Considering the joint memo of compromise filed by both parties and also considering the affidavit of undertaking filed by the petitioner 2/4

this Criminal Original Petition stands allowed and the proceedings in M.C.No.54 of 2021 pending on the file of the learned Additional Family Court, Coimbatore, is quashed and the terms of joint memo of compromise has been filed in the typed set of papers along with this petition, shall form part and parcel of this order.
