THE HONOURABLE MR.JUSTICE P. DHANABAL K.Markandeyulu ...Plaintiff Vs K.Kavitha ...Defendant Prayer: The suit has been filed under Order IV Rule of the O.S. Rules r/w Order VII Rule 1 of the Code of Civil Procedure prays for a Judgment and decree against the defendant:

(a) for declaration of grant of Decree and Judgment for partition and separate possession by dividing the entire property more fully described in the schedule hereunder into two divisions as per the share of the plaintiff and the defendant accordingly to the right they possess and enjoy and to pass a preliminary decree for the respective shares of the plaintiff and defendant and after passing preliminary decree by appointing an Advocate Commissioner by dividing the property by metes and bounds with the help of an Engineer and pass final decree for partition of the property and to obtain separate possession of the property of the Plaintiff and the Defendants from the schedule of the property; Page No.1 of 4

(b) to claim damages at the rate of Rs.5,000 per month from the defendant commencing from January 2021 till October 2022 the property is divided by metes and bounds by obtaining absolute separate possession of the property between the Plaintiff and the defendant; (c) to refund the court fee in this suit.

JUDGMENT

Learned counsel for the plaintiff seeks permission of this Court to withdraw this civil suit and she has made an endorsement to that effect in the bundle.
