PRAYER : Criminal Original Petition has been filed under Section 482 of Criminal Procedure Code, to direct the 2nd respondent to file a final report/charge sheet in Crime No.180 of 2021 within the period stipulated by this Court.

ORDER

This is a case for theft of machinery hypothecated from the complainant's Bank which is under investigation, in connection with, the first accused is before this Court to expedite the investigation. Page No.1/4

2. The learned Government Advocate (Crl.Side) states that without permission of the Bank, this petitioner is arrayed as first accused who has shifted the hypothecated machineries to Kalyana Mandapam. From the Kalyana Mandapam, machineries were taken away to an unknown place. The machineries are yet to be traced and that is the reason why, the investigation could not be completed.

3. The petitioner is not co-operating with the investigation and in any way taken into consideration of these facts, the completion of investigation is also in the hands of the petitioner's cooperation and therefore, time cannot be fixed for completing the investigation, but however, the respondent police shall take special interest in the case and complete the investigation as early as possible.
