Respondent(s) PRAYER : Petition under Article 226 of the Constitution of India, praying for issuance of writ of mandamus directing the respondent 1 to 7 to remove the encroachments made by 8th respondent in Survey No.153/1 in and around the 440w Electric Pole put up by the Tamil Nadu Generation and Distribution Corporation, in Tirur Village, Tiruvallur District in the land belong to the Tirur Panchayat to extent of 3x38 sq feet in northern side of the 8 th respondent House and shop by considering the petitioner representation dated 14.05.2024. ORDER
(Order of the Court was made by R.Suresh Kumar J.) The prayer sought for in this writ petition is to direct the respondents 1 to 7 to remove the encroachments made by 8 th respondent in Survey No.153/1 in and around the 440w Electric Pole put up by the Tamil Nadu Generation and Distribution Corporation, in Tirur Village, Tiruvallur District in the land belonging to the Tirur Panchayat to an extent of 3x38 sq.ft in northern side of the 8 th respondent's house and shop by considering the petitioner's representation dated 14.05.2024.
2.Heard the learned counsel for the writ petitioner and the learned Special Government Pleader for the respondents 1 to 7. 3.In view of order that is going to be passed in this writ petition, notice to the eighth respondent is dispensed with.
4.With regard to the grievance that is espoused in this writ petition by the petitioner, it is submitted by the learned Special Government Pleader appearing for the Revenue Department that already proceedings have been initiated under the provisions of the Tamil Nadu Land Encroachment Act against the eight respondent for the encroachment made by him on the Government land and notice under Section 7 of Act III of 1905 already been issued on 15.09.2025 and the copy of the which has also been produced by the learned Special Government Pleader.
5.In view of the said action initiated against the eighth respondent, recording the same, we feel that this writ petition can be disposed of. Therefore,
by recording the aforesaid development, this writ petition is disposed of. No costs.
