... Respondent ABDUL QUDDHOSE.J., Both the counsels submit that earlier the parties had tried to arrive at an amicable settlement. According to them, the settlement was almost reached. But, unfortunately, according to them, due to some serious medical ailment of the petitioner he was hospitalized and he could not take a call. The learned counsel for the petitioner would submit that if sufficient time is granted, parties shall report settlement of the matter.

2. Since the applicant in A.No.5853 of 2023 is not having any benefit of stay in this application, no useful purpose will be served if A.No.5853 of 2023 is allowed to be kept pending when the Arb. O.P. (Com. Div.) No.535 of 2023 is to be taken up for final disposal shortly. Accordingly, A.No.5853 of 2023 is closed.

3. In case settlement does not takes place before the next date of hearing, both the counsels are directed to file their brief notes of submissions along with the authorities they are relying upon on or before the next hearing date.
