Respondents Writ Petition filed under Article 226 of the Constitution of India, praying for issuance of a Writ of Mandamus directing the respondents to pay the unpaid salary from the month of January 2017 to till date to the employees of Tamil Nadu Industrial Explosives Ltd., and continue to pay the salary every month. ORDER
The grievance of the petitioner is that the salaries of the members of the petitioners Trade Unions from the month of January 2017 to till the date of filing of the writ petition has not been settled.
2.When the matter is taken up for hearing, learned Counsel for the respondent/Management submitted that the salaries have been paid and other dues have also been settled on 30.09.2017. 3.The learned counsel for the petitioners would submit that he has no instructions from the petitioners. However, since the settlement is made by the respondent Management, this Court is of the view that the writ petition need not be kept pending. On the other hand, the petitioners are at liberty to file a fresh writ petition in case the salaries have not been settled. 4.In the light of the above fact, this writ petition is closed with liberty to the petitioners to file a fresh writ petition, in case the salaries from the month of January 2017
till the date of filing of writ petition have not been paid. No costs.
