C.M.P.No. 25115 of 2023 in C.R.P. SR. No. 73258 of 2023 T.V. THAMILSELVI, J.

This petition has been filed seeking to condone the delay of 92 days in representing the above C.R.P.

2. Mr.G.Saravanan, learned counsel for petitioner submitted that the petition was returned on 03.07.2023 for compliance of certain defects. However, the returned paper was misplaced and thereafter, it was traced out only during last week. Hence he was not able to represent the petition in time. In view of the same, there is a delay of 92 days arose in representing the above C.R.P. and the said delay caused is neither willful nor wanton, but for the above said reasons. Accordingly, he has filed the above petition.

3. Considering the facts and circumstances, and the reasons stated by the petitioner in the affidavit is justifiable one. Accordingly, this court is inclined to allow this petition and Registry is directed to number the Civil Revision Petition if it is otherwise found to be in order. 06.12.2023 rpp https://www.mhc.tn.gov.in/judis
