This Writ petition has been filed with a prayer for issuing a Mandamus, to direct the respondents to pay the difference in Gratuity, leave salary, Commutation of pension based on wage settlement dated 04.01.2018 with 10% interest to the petitioners.
2. Ms.S.Pavithra, learned Standing counsel takes notice for the Respondents.
3. By consent, this Writ Petition is taken up for final disposal at the admission stage itself.
4.The case of the petitioner is that the petitioners who were working as Senior Tradesman and SG.Driver, retired from service on various dates. It is the grievance of the petitioner that their representations made before the 2nd respondent dated 07.07.2025 seeking to pay the difference in
gratuity, leave salary, Commutation of pension based on wage settlement dated 04.01.2018 with 10% interest has not been considered till date. Hence the present writ petition is filed.
5. The learned Standing Counsel for the respondents would fairly admit that in view of the similar orders passed by this Court in W.P.Nos 40031, 33742 and 35806 of 2024, they are willing to pay the interest at the rate of 6% per annum for the belated payment of the eligible and admissible amount.
6. In view of the above submission of the learned Standing Counsels, this Court deems it appropriate to direct the respondents to pay the eligible and admissible amount with interest at the rate of 6% per annum for the belated payment of terminal benefits, from the date of retirement till the date of actual disbursal of the terminal benefits of the petitioners, within a period of six weeks from the date of receipt of a copy of this order.
