ORDER

This Suo Motu Case is dealt with in an extraordinary manner by the Dedicated Bench, pursuant to Suo Motu.W.P.(Crl.) No.618 of 2025.

2. The occurrence in this case happened on 13.10.2021. The complainant is present and submits that his two wheeler bearing Registration No. TN-30-AD-6232 has been returned to him. The accused remains untraceable, despite best efforts. There is no previous case or subsequent case as against the accused.

3. Considering the long pendency, the complainant's stand and the fact that the accused remains untraceable, further continuation would impinge upon the right to a speedy trial. No useful purpose will be served by keeping the matter pending.

4. Accordingly, the case in CC.No.662/2022 on the file of the Judicial Magistrate III, Salem Taluk, Salem shall stand quashed and this Suo Motu Transfer Case stand disposed of.

11.09.2025 shl electronically alone. The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary.
