This petition has been filed to modify the condition imposed by this Court in Crl.M.P.No.16797 of 2022 in Crl.O.P.No.25491 of 2022 dated 22.11.2022 to enable the petitioner to furnish sureties through his friends. 2.The learned counsel for the petitioner would submit that the petitioner was granted bail in Crl.O.P.No.25491 of 2022 with a condition to deposit the original title deeds not less than the value of Rs.1 Crore (stands in the name of the petitioner or his relatives or friends) along with proper valuation certificate obtained from the authority concerned, to the credit of Crime No.90 of 2022, within a period of two weeks from the date of receipt of a copy of the order, without prejudice to their right of defence. Subsequently, the petitioner has filed a Criminal Miscellaneous Petition in Crl.M.P.No.
16797 of 2022 to modify the said condition and the same was allowed by this Court on 22.11.2022. However, now the petitioner has filed the present petition to modify the condition imposed in Crl.M.P.No.16797 of 2022 that the petitioner is ordered to be released on bail on his executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two blood related sureties, each for a like sum to the satisfaction of the learned Metropolitan Magistrate Court, CCB Court, Egmore. He would also submit that the petitioner has no relatives except his mother, who is aged about 80 years old, however, she was bedridden due to her old age. Therefore, the petitioner is unable to comply with the condition imposed by this Court and thereby, he seeks for modification of the above condition. https://www.mhc.tn.gov.in/judis Page No.

3. The learned Government Advocate (Crl. Side) appearing for the respondent police would submit that the mother of the petitioner is alive and hence, he has opposed for modification of the condition imposed by this Court.

Considering the said submissions and also the fact that the reasons given by the petitioner is not acceptable because his mother is alive, this Court is not inclined to modify the condition imposed by this Court in Crl.M.P.No.16797 of 2022 in Crl.O.P.No.25491 of 2022 on 22.11.2022. 5.Accordingly, this Criminal Miscellaneous Petition is dismissed. 12.12.2022 sp Crl.M.P.No.18699 of 2022 in Crl.O.P.No.25491 of 2022 https://www.mhc.tn.gov.in/judis Page No.2/2
