This application has been filed to condone the delay of 944 days in representing the Appeal papers.
2.It is, however, seen from the records refers that the 2 nd respondent has died. In the affidavit, it has been stated that when the office was cleaned in December 2015, the returned appeal papers have been located and they have been represented immediately. Again, the Registry returned them. The appellant could not mobilize sufficient funds to obtain copies of the pleadings and other records. In all these procedures, there has been a delay of 944 days in representing the appeal papers. It is also noted that the 1 st and 2 nd respondents have died. However, the delay is condoned.
3.The appeal papers may be represented before the office and necessary steps must also be taken to bring on record the legal representatives of the 1 st and 2 nd respondents before the appeal is numbered.
