Respondents PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, praying for the issue of Writ of Mandamus, directing the 1st respondent to issue a equivalence certificate declaring the M.Sc Applied Microbiology Degree offered by University of Madras as equivalent to M.Sc Microbiology as approved in the case of Bharathiyar University, Thiruvallur University and the Periyar University vide G.O.Ms.No.65 dated 24.04.2019.

By consent, the main writ petition is taken up for disposal at the admission stage itself.
2. The petitioner herein has completed her M.Sc Applied Microbiology in the year 2004 from Adhiparasakthi College of Science, Kalavai, Vellore, which is affiliated to the University of Madras. He has applied for the post of direct recruitment PG (Assistant) / Physical Education Directors Grade-I in School Education and other departments conducted by the Teachers Recruitment Board. Since his M.Sc Applied Microbiology degree is equivalent to M.Sc Microbiology degree, he is fully qualified to apply for the said post. However, the application made by him to the 1st respondent to grant equivalence certificate is pending as on date, hence, apprehending his application may be not considered by the 2nd respondent, he has filed this writ petition seeking Mandamus to direct the 1st respondent to issue equivalence certificate declaring M.Sc Applied Microbiology offered by the University of Madras is equivalent to M.Sc Microbiology as in the case of of Bharathiyar University, Thiruvallur University and the Periyar University.

When the matter came up for hearing, the learned counsel for the petitioner would place the Government Order passed by the Government in G.O.Ms.No.27 (Higher Education Department) dated 13.02.2014, wherein, the Government has considered the equivalence M.Sc Applied Microbiology offered by the Madras University and treated it as equivalent to M.Sc Microbiology as early as 2014.
4. In view of this G.O., it is not necessary to issue any further Government Order. The Government has consciously issued the subsequent G.O.Ms.No.65 dated 24.04.2019 only in respect of other Universities such as Bharathiyar University, Thiruvallur University and the Periyar University omitting the Madras University, since the Government has already passed the G.O., as early as 13.02.2014.

In the light of the above fact, the 2nd respondent shall take note of G.O.Ms.No.65 dated 24.04.2019, granting certificate that M.Sc Applied Microbiology of Madras University is equivalent to M.Sc Microbiology and accept the application of the petitioner and permit him to participate in the selection process.
6. With the above directions, this writ petition stands disposed of. No costs.
