ORDER

This writ petition has been filed for Mandamus seeking for a direction to the first respondent to pass final orders on the petitioner's representation dated 31.10.2022 and to issue appropriate orders to the second respondent for appointing the petitioner as Village Assistant in the ongoing selection proceedings, under General or Priority category with age relaxation in respect of G.O.Ms.No.188, P&AR dated 28.12.1976, G.O.Ms.No.142, P&AR, Dept., dated 14.10.2009 and G.O.Ms.No.21, Labour and Employment Dept., dated 02.02.2000

2. The petitioner claims that he is entitled to be appointed as Village Assistant as per the aforementioned Government Orders. He has given a representation on 31.10.2022 for the said purpose. Since, the 2/5

representation has not been considered, he has filed the writ petition.

3. Heard Mr.I.Kabilan, learned counsel for the petitioner. Mr.Stalin Abimanyu, learned Additional Government Pleader accepts notice on behalf of the respondents.

4. No prejudice would be caused to the respondents, if the petitioner's representation as stated supra is considered on merits and in accordance with law, within a time frame to be fixed by this Court. It is for the respondents to decide as to whether the G.Os relied upon by the petitioner is applicable to the case or not.

5. For the foregoing reasons, this Court directs the first respondent to pass final orders on merits and in accordance with law, on the petitioner's representation dated 31.10.2022, seeking for his appointment as Village Assistant, within a period of twelve weeks from the date of receipt of a copy of this order. While passing final orders, the first respondent shall decide as to whether G.O.Ms.No.188, Personnel and Administrative Reforms (Personnel-P) Department dated 28.12.1976, G.O.Ms.No.142, Personnel and Administrative Reforms (Personnel-P) 3/5

Department dated 14.10.2009 and G.O.Ms.No.21, Labour and Employment (N-2) Department, dated 02.02.2000, are applicable to the case of the petitioner or not.

6. With the aforesaid direction, the writ petition stands disposed of. No costs. Consequently, connected miscellaneous petition is closed.
