This application is filed seeking a direction to the third respondent to raise the order of attachment dated 08.11.2017 made in A.No.5367 of 2017, in respect of the schedule property.

2. Heard the learned counsel for the applicant.

3. This Court, on 08.11.2017, passed an order of attachment under Section 9 of The Arbitration and Conciliation Act, pursuant to the award passed by the Arbitrator dated 16.08.2017. The said order of attachment is duly communicated to the 3rd respondent, vide letter dated 19.01.2018. Thereafter, the award was challenged in O.P.No.996 of 2017. During the pendency of the said original petition, a settlement has been arrived at between the applicant, first respondent and the second respondent and they have also entered into a memorandum of compromise dated 30.04.2019. In view of the said compromise, attachment has to be raised.

4. Accordingly, the order dated 08.11.2017 passed in A.No.5367 of 2017 is raised and vacated and the application is ordered. 22.11.2019 vsm Note: Registry to mark a copy of this order to the Sub-Registrar, http://www.judis.nic.in
