(Order of the court was made by the Hon'ble Acting Chief Justice) This miscellaneous petition has been filed to condone the delay of 243 days in filing the writ appeal against the order dated 25.10.2021 passed by the learned Single Judge in W.P.No.12398 of 2018.

2. Mr.R.Bharath Kumar, learned counsel appearing on behalf of the writ petitioner/first respondent herein, submitted that if the appeal is taken up on merits and disposed of expeditiously, he has no objection for condoning the delay of 243 days in filing the writ appeal.

3. Mr.J.Ravindran, learned Additional Advocate General appearing on behalf of the petitioners, placing on record the proceedings of the first petitioner/District Collector, Krishnagiri

District, submitted that the land in question covered in S.No.77/5 of Shoolagiri Village, Krishnagiri District, belonging to the first respondent has been handed over to him. Recording the same, he pleaded that the writ appeal may be disposed of.

Mr.R.Bharath Kumar, learned counsel appearing on behalf of the first respondent, would submit that since a pucca thar road has been laid on the land belonging to the first respondent and the public are using the same and, therefore, the petitioners may be directed to remove the thar road to enable the first respondent fence his land.

5. Learned Additional Advocate General sought for two weeks' time for removal of the thar road in the land belonging to the first appellant.

In view of the no objection given by learned counsel for the first respondent for condonation of the delay, C.M.P.No.21560 of

2022 is allowed. The Registry is directed to number the writ appeal and list the same after two weeks for reporting compliance. (T.R., A.C.J.) (D.B.C., J.) 16.03.2023 sasi
