ORDER

This Suo Motu Case is dealt with in an extraordinary manner by the Dedicated Bench, pursuant to Suo Motu W.P.(Crl.) No.618 of 2025.

2. This case is registered for alleged offences under Sections 279 and 337 of the Indian Penal Code. The incident occurred on 09.07.2019. It is seen that the dependent of the dead person is not even aware that Claim Petition can be filed. No Claim Petition is filed. The closure of this case will not in any manner affect the Claim Petition if any filed. The case is closed only because the accused remains untraceable and in future, even if the Page No.1 of 3

warrant is executed and accused is brought to face trial, that will impinge upon his right to speedy trial. However, as far as the claim is concerned, let the Investigating Officer furnish a set of papers to the dependent of the dead person and if they are not in a position to engage a lawyer for themselves, the help of the Legal Services Authority can also be availed.

3. With the above observations, the case in S.T.C.No.60 of 2021 of Judicial Magistrate I, Sankari Taluk, Salem, stands closed. This Suo Motu Transfer Case is disposed of.

12.09.2025 grs electronically alone. The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary. Further, the Court below is directed to dispatch the copy of this order to all concerned.
