The prayer sought for in this writ petition is for a Writ of Mandamus directing the respondents to issue Patta in respect of the property of the petitioner comprised in Survey No.141/1 bearing Plot No.4A & 4B of an 1/4
extent of 2214.5 sq.ft. situated in Kovilambakkam Village, Solinganallur Taluk, Chengalpet District.
2. The petitioner claims that the property at Survey No.141/1 at Kovilambakkam Village, Sholinganallur Taluk, Chengalpet District originally was allotted to one Subbammal who is none other than the grandmother of the petitioner, who settled the property by way of settlement dated 24.03.1986 to and in favour of the mother of the petitioner, from whom the property was settled in favour of the father of the petitioner in 1995 that is how the petitioner subsequently has inherited the property. In order to get patta for the said property, the petitioner though had given application through registered post on 19th October 2022, the same since has not been considered by the 2nd respondent/Tahsildar, he has approached this Court.
3. Heard Mr.P.Sathish, learned Additional Government Pleader appearing for the respondents who would submit that, as per the procedure in vogue, the application should be filed through online for getting patta under the provisions of the Patta Passbook Act. Therefore if at all any such 2/4
application is made by the petitioner, that would be considered by the 2nd respondent/Tahsildar and decided on merits within a time frame that may be stipulated by this Court.
4. Considering the said submission made by the learned Additional Government Pleader appearing for the respondents, having regard to the aforestated factual matrix, this Court is inclined to dispose of this writ petition with the following orders:
That the petitioner shall make an online application seeking patta for the property concerned to the 2nd respondent through web portal within a period of two weeks and on receipt of such online application, the 2nd respondent shall consider the same and pass orders thereon on merits and in accordance with law within a period of four weeks from the date of receipt of such application.
