ORDER

Challenging the rejection of permission for conducting a pubic meeting, the present Writ Petition has been filed .

2. The grievance of the petitioner is that though the permission has been granted by the Inspector of Police for conducting a procession in connection with Vinayakar Chaturthi, permission was not granted for holding a meeting to address the gathering with regard to the procession and to highlight the importance thereof.

3. The learned Additional Public Prosecutor, on instructions, would submit that the rival group has already been granted permission to conduct a public meeting about 1 1⁄2 kms away. It is further submitted that there is no necessity to permit another meeting for the minority group and that certain criminal cases are also pending against them. 2/5

4. Whereas the learned counsel for the petitioner would submit that there is no split in the group. It is only on account of discussions and in order to avoid the crowd, two places have been chosen.

Be that as it may, since police had already grated permission for procession and now the petitioner seeks permission only for conducting a public meeting for the limited purpose of giving instructions to the participants regarding the dos and dont's during the procession and also to address the importance of Vinayakar Chaturthi, this Court is of the view that limited permission may be granted.

6. In such view of the matter, let the respondents permit the petitioner to conduct the said public meeting subject to the following conditions:- i) The petitioner shall not erect any stage for the meeting ii) The petitioner shall use one mike and the number of speakers shall not exceed two.

iii) The petitioner shall given an undertaking before the respondents that they will not create any law and order problem on account of the meeting.

7. With the above directions, this writ petition (crl.) is disposed of. No costs.
