This petition has been filed seeking for a direction to the respondent police to defreeze the Savings Bank Account of the petitioner maintained with the HDFC Bank Limited.
2. Heard Mr.K.Sukumaran, learned counsel for petitioner and Mr.A.Damodaran, learned Additional Public Prosecutor appearing for respondent.
3. When the matter came up for hearing, learned Additional Public Prosecutor, on instructions, submitted that the bank account of the petitioner was freezed on 11.01.2023. However, the same was not immediately informed to the concerned Magistrate Court as mandated u/s.102 Cr.P.C.
4. In the light of the above submission, the very freezing of the bank account is illegal since the mandate u/s.102 Cr.P.C. has not been complied with. There shall be a direction to the respondent to defreeze the bank account of the petitioner. If, in the course of investigation in Crime No.21 of 2022, the respondent deems it fit to freeze the bank account, the 2/4
respondent shall strictly comply with the mandate u/s.102 Cr.P.C.
