The complaint given by the petitioner herein against her husband registered under Sections 498A, 406 and 506(ii) not reached the stage of final report. Hence, present petition is filed to direct the respondent police to 1/4
file final report within stipulated time. The complaint been registered in Crime No.69 of 2018 on 23.01.201. Inspite of five years lapse from the date of complaint, till date investigation not yet completed.
2. The learned Government Advocate (Crl. Side) submitted that, husband of the petitioner is in USA and therefore, there is a delay in filing final report.
3. If the husband of the petitioner is absconding, he may be shown as absconding accused in final report and proceed in accordance with law. Police cannot wait for eternity for the first accused to turn up. Hence, Criminal Original Petition is disposed of with a direction to the respondent police to file final report within a period of three months from the date of receipt of copy of the order.
