These applications are filed (i) to condone the delay; (ii) to set aside the abatement and (iii) to bring on record the LRs of the deceased plaintiff in T.O.S.

No.15 of 2016.

2. Having satisfied with the reasons stated in the affidavits filed in support of these applications, these applications are allowed and the delay of 389 days in filing the application to set aside the abatement caused due to the death of the plaintiff, is condoned. Abatement set aside. The applicant in A. No.333 of 2023 is brought on record as LR of the deceased plaintiff in T.O.S. No.15 of 2016.

3. Learned counsel for the plaintiff is directed to carry out the amendment to the cause title of the plaint on or before 02.02.2023.
