The matter is listed today under the caption "for being mentioned" at the instance of the learned counsel for the petitioner/appellant.

2. It is brought to the notice of this Court that the learned counsel for the petitioner/appellant sought permission to withdraw the civil miscellaneous petition. However, in the order dated 26.11.2024, the CMA. Itself was shown as dismissed at the SR stage itself. Therefore, he prays that necessary corrections may be made in the order dated 26.11.2024 with further direction to the Registry to number the appeal and list the same for hearing.

3. This Court perused the order dated 26.11.2024 and also the endorsement made by the learned counsel for the petitioner/appeal and finds that though the petitioner had only not pressed the miscellaneous petition seeking to accept the cause title of the appellant in the above civil miscellaneous appeal filed against the order in EC. No.56/2016 dated 04.07.2024. However, in inadvertently, the appeal itself was shown to have been dismissed at the SR stage.

4. In such view of the matter, the order dated 26.11.2024 stands modified with the following:

''ORDER When the matter is taken up for hearing, the learned counsel for the petitioner seeks permission of this Court to withdraw the miscellaneous petition and to that effect, he has made an endorsement in the case bundle.

2. Recording the above submission and endorsement made by the learned counsel for the petitioner, this Civil Miscellaneous Petition is dismissed as withdrawn. No costs.

3. Registry is directed to the number the civil miscellaneous appeal, if it is otherwise in order and list the same for hearing.''

5. This Court also finds that the date of the order just below the signature is erroneously shown as 22.11.2024 whereas the order was passed on 26.11.2024. The said date shall also stand corrected as 26.11.2024. Registry is directed to issue a fresh order copy after making necessary corrections. 10.07.2025 rli
