PRAYER: Criminal Original Petition filed under Section 482 of Cr.P.C, to direct the respondents to pass an order on the basis of the representation of the petitioner dated 23.10.2019 in accordance with law and direct the third respondent to return the vehicle TATA Sumo bearing Registration Number.TN61-C-4197 on the custody of the third responsdent herein to the petitioner to secure the ends of justice. O R D E R

This petition has been filed seeking a direction, to direct the respondents to pass an order on the basis of the representation of the petitioner dated 23.10.2019 in accordance with law and to direct the third respondent to return the vehicle TATA Sumo bearing Registration No.TN-61-C4197 on the custody of the third responsdent herein to the petitioner to secure the ends of justice.

2.The learned Additional Public Prosecutor has submitted that the petition mentioned vehicle namely TATA Sumo bearing Registration No.TN-61-C-4197 has been seized by the third respondent in Crime No.273 of 2019 and the same was produced https://hcservices.ecourts.gov.in/hcservices/

before the Judicial Magistrate No.II, Perambalur and remanded in CP No.34 of 2019 dated 08.11.2019 and hence, the third respondent cannot pass order on the representation submitted by the petitioner dated 21.10.2019.

3.Since the said vehicle has been produced before the Judicial Magistrate No.II, Perambalur, the third respondent cannot pass any order on the representation submitted by the petitioner dated 21.10.2019. It is open to the petitioner to file petition under Section 451 of Cr.P.C., before the concerned Magistrate.

4.With the aforesaid directions, this Criminal Original Petition is disposed of.
