The petitioner has filed this Writ Petition on 19.12.2023 challenging demand notice in Form 1 dated 08.09.2023 issued under Section 7 of the Revenue Recovery Act, 1864 calling upon the petitioner to remit arrears of a sum of Rs.30,43,009.49. Though the demand notice is dated 08.09.2023, this Writ Petition is filed belatedly, after four months. No explanation is set forth as to what caused the delay. Hence, I am inclined to dismiss this Writ Petition solely for this reason.
2. That apart, the order passed, on which the impugned demand is made is stated to be a subject matter of appeal before the Tamil Nadu Real Estate Appellate Tribunal, Chennai (in short 'Tribunal').
3. This is clear from letter dated Nil received in the Tahsildhar's Office on 20.09.2023, furnished at page 27 of the typed set, citing the aforesaid appeal. In that letter, a representation has been made on behalf of the petitioner citing the appeal filed and seeking interim protection from the Tribunal. The reference in that letter is to the demand notice which is impugned in this Writ Petition. 2 / 4
4. Hence, I am of the categoric view there is no merit in this Writ Petition as clearly the petitioner is approaching multiple fora seeking the same relief. This writ petition is dismissed. No costs.
