Respondents PRAYER: Petition has been filed under section 226 of the Constitution of India to issue an order of Writ of Declaration, declaring Rule 6 of Refund Rules, Railway Passengers (Cancellation of Tickets and Refund of Fares) Rules 1992 and the consequential order of the second respondent, in No.C.508/II/MAS/RB/2003/35, dated 26.02.2004, as illegal, arbitrary, ultra vires and unconstitutional and to direct the respondents to refund the entire fare after adjustment of clerical charges, if any, in Ticket PNR.No.432-6097010 and to pass further orders. O R D E R

The Writ Petition has been filed by Mr. L.Chandrakumar, under Article 226 of the Constitution of India, seeking for declaring Rule 6 of Refund Rules, Railway Passengers (Cancellation of Tickets and Refund of Fares) Rules 1992 and the consequential order of the second respondent dated 26.02.2004, as illegal, and also to direct the respondents to refund the entire fare after adjustment of clerical charges, if any, in Ticket PNR.No.4326097010 and to pass further orders. 2.

Learned counsel appearing for the petitioner submitted that he is not pressing this Writ Petition, as he was instructed by his client to withdraw the same. The learned counsel has also made an endorsement to the said effect. https://hcservices.ecourts.gov.in/hcservices/

3. Recording the submission of learned counsel for the petitioner and in view of his endorsement, this writ petition is dismissed as withdrawn. Consequently, the connected M.P is closed. No order as to costs.
