JUDGMENT

(Delivered by the Hon'ble Chief Justice) Heard Mr.V.Karthikeyan, learned counsel appearing for Mr.V.Nicholas, learned counsel for the appellant and Mr.A.Edwin Prabakar, learned State Government Pleader for the respondents.

2. The appellant is challenging the order passed by the learned Single Judge in W.P.No.6288 of 2023 dated 09.08.2023.

3. The present appellant filed a writ petition seeking directions against the respondents to remove the old structure and handover the vacant possession to the appellant. The learned Single Judge disposed of the writ petition by observing that it is for the appellant to approach the civil court for the relief claimed.

4. Learned counsel for the appellant submits that the appellant is the owner of the property, having purchased the land under the registered sale deed from his predecessor, who is also issued with the patta of the land. The order has become final.

5. According to the learned State Government Pleader, the land in question is a Government poromboke land. The learned Single Judge observed that this court, under writ jurisdiction, cannot conduct a roving inquiry in respect of disputes of civil nature. The learned Single Judge granted liberty to the appellant to approach the competent civil court for the purpose of establishing the right.

6. We do not find any error committed by the learned Single Judge. The writ appeal, as such, stands disposed of. There shall be no order as to costs.
