This civil miscellaneous petition has been filed seeking to condone the delay of 168 days in filing the above Civil Miscellaneous Appeal.

2. In view of the endorsement made by the learned counsel for the appellant, notice to the 2nd respondent is dispensed with.

3. Heard Mr.M.Murali Vinodh, learned counsel appearing for the petitioner/appellant and Mr.R.Nalliyappan, learned counsel appearing for the 1st respondent.

4. Sufficient reasons have been given in the affidavit filed in support of the petition. Accordingly, the delay is condoned and the petition is ordered.
