ORDER
The Revision Petitioner husband filed a petition in H.M.O.P.No.202 of 2021 before the Principal Sub-Judge, Kallakurichi for the relief of restitution of conjugal rights, in which the respondent also appeared. Now, the case is riped for trial and the case is posted for cross-examination of 1/3
P.W.1 on 14.11.2022, but as on date, he was not cross-examined. Therefore, he wanted to direct the trial court to dispose the case as early as possible.
2. Since the relief claimed by the Revision Petitioner only seeking a direction for a speedy disposal, the notice to the respondent is dispensed with.
3. E-court perused. On perusal of e-court status, from the date of 14.11.2022, the trial judge adjourned the matter for cross-examination of P.W.1 and for more than two years, there is no progress in the trial, as such it would show that the trial court is not inclined to proceed with the matter as per manner known to law. Therefore, this Court is inclined to direct the trial judge to commence the trial and dispose the case as expeditiously as possible within a period of three months without giving unnecessary adjournment from the date of receipt of copy of this order.
