The third party, which was the highest bidder in relation to the auction of a property, has applied for payment out of the amount deposited towards purchase of the property.

2. The certificate of funds discloses that a sum of Rs.9,80,60,000/- was deposited by the applicant in relation to purchase of the property.

3. All the parties submit that the sale could not be concluded because the bank dues were discharged. Therefore, the parties do not have any objection to this application being allowed.

4. For reasons set out above, this application is allowed by directing that the sum of Rs.9,80,60,000/- be paid out to the applicant after effecting deductions, if any.
