PRAYER : Petition under Article 226 of the Constitution of India praying for issuance of Writ of Mandamus, directing the respondents 1 and 2 to restore the electricity supply to S.C.No.279/001/1567 to the petitioner's business premises namely M/s. D.S. Chicken Center, Keezhil Vedhi, Panapakkam Town Panchayat, Nemili Taluk, Vellore District. Heard Mr.G.Jeremiah, learned counsel for the petitioner, Mr.M.Varun Kumar, learned counsel for the respondents 1 and 2, Mr.M. Elumalai, learned Government Advocate for 3rd respondent and Mr.V.Balaji, learned counsel for 4th respondent.
2. With the consent of learned counsel on either side, this writ petition itself is taken up for final disposal. https://hcservices.ecourts.gov.in/hcservices/
3. The petitioner seeks for issuance of a writ of mandamus to direct the respondents 1 and 2 to restore the electricity supply to S.C.No.279/001/1567, the petitioner's business premises namely M/s. D.S. Chicken Center, Keezhil Vedhi, Panapakkam Town Panchayat, Nemili Taluk, Vellore District.
4. In the counter affidavit filed by the 2nd respondent, it is stated that on inspection, it was found that the shop was closed and there is no board mentioning D.S.chicken centre. The key of the shop was available with the 4th respondent and based on his request, the electricity service connection was disconnected and the meter has also been dismantled. Therefore, the question of restoring the electricity supply will not arise at this juncture. Hence, the writ petition is dismissed. However, it is well open to the petitioner to work out his rights before the appropriate forum, if still a need arises to do so. No costs. Consequently, connected MP is closed.
