ORDER

(Order of the Court was made by N.Sathish Kumar J.) This petition has been filed to condone the delay of 239 days in filing the above appeal.

2. The learned counsel for the petitioner/appellant submits that the judgment and decree was passed on 10.02.2025, but there was a delay in filing the copy application by the counsel due to oversight.

3. Ms.Vindhya Vasini, learned counsel for sole respondent submits that the reasons assigned by the petitioner / appellant is not satisfactory and hence, the petition may be allowed on payment of cost.

4. Though the reasons assigned are not convincing, in order to give fair opportunity to advance arguments on merits, we are inclined to condone the delay on payment of cost.

5. Accordingly, this petition is allowed subject to the condition that the petitioner/appellant pays a sum of Rs.1000/- [Rupees One Thousnad Only] as costs to the counsel for respondent on or before 11.02.2026, failing which this application shall stand dismissed.
