Naina N Patel v. The Secretary To Government

2022-12-08Honourable Mr Justice M. Sundar2 pages

W.M.P.No.32381 of 2022 in W.P.No.32980 of 2022 W.M.P.No.32381 of 2022 in W.P.No.32980 of 2022 M.SUNDAR, J., Captioned 'Writ Miscellaneous Petition' ['WMP'] has been filed under Rule 15 of 'Madras High Court Writ Rules, 2021' [hereinafter 'Writ Rules 2021' for the sake of convenience and brevity] with a prayer to permit seven writ petitioners to file a single writ petition.

2. Mr.G.Gokul, learned counsel on record for writ petitioners submits that a 'notice dated 08.07.2022 bearing reference No.GR2022/SPL009/079602 issued by second respondent' [hereinafter 'impugned notice' for the sake of convenience and clarity] has been called in question. Learned counsel submits that the impugned notice pertains to upward revision of property tax, seven writ petitioners belong to one family, they are joint owners of property which is subject matter of upward revision. This means that the source of right is common. It is also to be noted that the prayer is common and in this view of the matter, the prayer to file a single writ petition is acceded to albeit with a rider that seven writ petitioners should pay separate Court fee.
